A Milestone Reached – Sort Of!

A few years delayed by the pandemic, CMS and ACL announced today:“Today marks an important milestone in our national efforts to enable people with disabilities and older adults to live and fully participate in their communities: the end of the transition period for implementation of the Medicaid Home and Community-Based Services (HCBS) settings regulation. Effective today, all states must be fully compliant with the regulation’s requirements to uphold specified basic rights and may, through time-limited corrective action plans, have additional time to fully comply with the remaining criteria impacted by the COVID-19 public health emergency.”

A quick search seems to indicate that 1) none of the CAPs submitted to extend the date to achieve full compliance (including Virginia’s) have been approved, and 2) some states still do not have a “final” transition plan submitted and approved.
