DMAS released information this morning to clarify the posture of several sets of regulations:
The Emergency Regulations which have been in effect since July 2011 have expired (they are no longer available on the Virginia Administrative Code website, but are posted on the VNPP Provider Resources page).
According to DMAS:
These emergency regulations have expired at the state level, but are still in effect through federal authority granted Virginia in the Medicaid state plan. Further, many elements of these regulations (including staff qualification requirements) are also included in DBHDS regulations – providers must continue to comply with all DBHDS rules and regulations.
