For those keeping track, the hearing scheduled for this week in Judge Gibney’s court has been postponed. The plan had been to hear arguments on the DOJ motion to establish a court-ordered timeframe/schedule for implementation of the Settlement Agreement.
Our post on the Status Conference (23 October) suggested that, in our opinion, Judge Gibney’s seemed inclined to give the Legislative process time to play out. The inclusion of the Waiver Redesign in the Governor’s Budget may have played a role in the delay of the hearing.
