Governor’s Amendments

June 27, 2026

The only item of specific interest to us in the Governor’s list of “technical amendments” is one that partially advances the rate increace for agency and consumer-directed personal care, respite and companion services from 8% on January 1, 2028 to 4% on January 1, 2027 and an additional 3.9% on January 1, 2028.   It seems unlikely that this one will be controversial!

On the issue of rates – for those of you who were not on the Member Call yesterday – like the elimination of community stabilization, changes in ABA services, and reduction in allowable hours for mobile crisis, all of the rate increases  require CMS approval.  Given that at best the Budget will be signed by the Governor on Monday (6/29), none of the requests for review can be submitted/approved by CMS before 1 July!   Once approved, DMAS will honor the increases beginning for services provided effective July 1st.

We will ask DMAS to consider automatically adjusting claims when they have the approval, this will eliminate the time consuming manual adjustments required especially when billing is done via the EHR.   We’ll let you know what we find out!
