The Governor signed the proposed stage of the MHSS regulations on August 3
rd, and the proposed stage text will be published in the Virginia Register on August 24, 2015. On that day, a 60-day public comment period will open on the Virginia Regulatory Town Hall, and that will remain open until October 23, 2015.
After the public comment period closes, the regulations will move to the final stage, which will involve possible text changes related to the public comments, and final executive branch review (including review by the Office of the Attorney General, the Department of Planning and Budget, the Secretary of Health and Human Resources, and finally, the Governor). The regulations will become effective after the Governor signs the final stage and after the final stage is published in the Virginia Register.
DMAS does not intend to apply the 15 minute unit. They will work to remove the 15 minute language in the public comment period. Once the final stage text of the MHSS regulation is developed and is moving through Executive Branch review, DMAS/Magellan will communicate with providers about any changes that may occur, and when they might be expected. In the meantime, and as this process moves forward, you will be able to view the proposed stage and final stage regulatory text and related documents on the Virginia Regulatory Town Hall.
